Nevada Activists Attempts to Change Levy Higher Taxes on Casino Operators
The results of a report on gambling commissioned by the Australian government were recently released. The report’s conclusions were largely negative, and indicated that the introduction of a fleet of gambling machines in Western Australia has been more destructive than beneficial to the surrounding communities.

A Clark County, Nevada activist plans to file an initiative petition to impose a higher tax rate on Nevada casino complexes, with the extra money used to decrease taxes for single-family homeowners.

Tony Dane tried to file the petition to get his bill on the ballot yesterday. Although he was turned away because initiative petitions may not be filed until January 3rd, Dane was not deterred. He announced that he will file his petition on that date. If he then collects signatures from 83,184 Nevada residents who support the initiative, his bill will go to the Legislature for consideration in 2007. If the Legislature does not pass the bill, the matter will be put to a general vote in 2008.

Dane has collected $100,000 to finance this campaign, which would raise the tax rate on casinos earning more than $410,000 a month to 18.25 percent, from the current rate of 6.75 percent.

Smaller casino operators, that is, those that gross under $410,000 a month, would be taxed at a rate of 5.5 percent.

Dane arrived at the proposed tax rate of 18.25 percent by averaging the tax rates on casino profits in other states. The average tax rate on casino profits on the United States, excluding Nevada, is 16.25 percent, according to Dane. He then added another 2 percent to raise the sum slightly above the national average, and to increase revenue for the state.

Predictably, the Nevada gaming industry has come out against Dane’s proposal. They argue that the tax raise would put a halt to investments made by existing casino operators, as well as investments by new casino ventures. Bill Bible, president of the Nevada Resort Association, argued that the new tax rate would cost the state thousands of new jobs.

"Nevada's tax structure permits reinvestment," he said. "That's why we see so many major projects occurring in Southern Nevada, and why there are so many more on the drawing boards."

In response to this argument, Dane said that he would be loath to cause any damage to casinos’ reinvestment possibilities. He was inspired to take on this project, he said, because he saw that Nevada casino operators were investing their profits in other states, including many with higher casino tax rates.

The casino industry also objects to the proposed use of the money generated by the plan. Why should the casino industry, they ask, subsidize single-family homeowners, particularly those whose properties are worth millions of dollars.

"It's a redistribution scheme," accused Bible. "It punitively targets the gaming industry. It singles the industry out for taxation to buy down the property tax for multimillion-dollar property owners to those with more modest homes."

Dane said that it was unfair that the Nevada 2003 Legislature and Gov. Kenny Guinn raised taxes significantly on many businesses but excluded the casino industry. The 2003 tax increases on business and other revenue sources such as cigarettes and alcohol was pushed by the gaming industry because the industry didn't want a gaming tax increase, Dane said.

"The Legislature doesn't have the guts to raise gaming taxes, so we'll let the people do it for them," he said.
